1. Introduction

Welcome to GlobalCoach AI ("the Platform," "we," "us," or "our"). By accessing or using our platform, you ("User," "you," or "your") agree to be bound by these Terms and Conditions. GlobalCoach AI is an AI-powered learning platform that allows users to upload documents, generate practice tests, take certification and exam preparation courses, receive AI-graded essay feedback, track concept-level mastery with adaptive learning, create AI-generated study plans, and monitor their learning progress. Please read these terms carefully before using our services.

2. Important: AI-Generated Content Disclaimer

GlobalCoach AI uses artificial intelligence (including third-party large language models) to generate practice tests, questions, answers, explanations, essay grades, performance summaries, study plans, mastery scores, adaptive recommendations, and other educational content. While we strive to provide accurate and helpful content, AI technology is inherently prone to errors, inaccuracies, hallucinations, and limitations.

You acknowledge and agree that:

All AI-generated content — including questions, correct answers, explanations, essay feedback, rubric scores, concept tags, and performance summaries — may contain factual errors, inaccuracies, or misleading information. You are solely responsible for independently verifying all content against authoritative and reliable sources before relying on it.
AI-generated essay grades, rubric scores (content accuracy, depth of analysis, concepts covered, clarity), and written feedback are automated approximations, not expert human assessments. They should not be treated as definitive evaluations of your knowledge or ability.
Mastery scores, readiness scores, confidence scores, adaptive insights, spaced repetition schedules, and study recommendations generated by the platform are algorithmic estimates based on limited data. They do not guarantee actual proficiency, exam readiness, or learning outcomes.
Certification track content (including questions for AWS, CompTIA, Azure, PMP, CISSP, and other certifications), standardised test preparation content (GCSE, SAT, IELTS, WAEC, JAMB, and others), and conceptual framework materials are not endorsed by, affiliated with, or approved by the respective certification bodies, examination boards, or educational institutions.
Study plans, daily task schedules, and learning recommendations are AI-generated suggestions and do not guarantee exam success, certification attainment, or any specific academic outcome.
You should not rely solely on AI-generated content for critical academic, professional, certification, medical, legal, financial, or personal decisions.
You should use the platform as a supplementary learning tool, not as a primary or sole source of information.
You should report any errors or inaccuracies you encounter to help us improve our service.

GlobalCoach AI, its owners, operators, and affiliates expressly disclaim all liability for any errors, omissions, or inaccuracies in AI-generated content, and for any decisions made, actions taken, or outcomes resulting from reliance on such content.

3. No Professional, Academic, or Certification Guarantee

GlobalCoach AI is an educational practice tool. We do not guarantee that use of the platform will result in passing any exam, obtaining any certification, achieving any grade, or meeting any academic or professional standard.

Practice tests, mock exams, and domain assessments on this platform do not replicate the exact format, content, difficulty, or conditions of actual certification exams or standardised tests.
Scores, pass/fail indicators, readiness assessments, and "mastered" status shown on the platform reflect performance on AI-generated practice content only and should not be interpreted as predictions of real exam performance.
Certification names, exam names, and provider names (e.g., AWS, CompTIA, Microsoft, Google, Cambridge, College Board, IELTS, WAEC, JAMB) are trademarks of their respective owners. Their use on this platform is for identification purposes only and does not imply endorsement, sponsorship, or affiliation.
The platform is not a substitute for official study materials, accredited courses, or professional instruction.

4. Account Registration and Eligibility

Age requirement: GlobalCoach AI is intended for users aged 16 and over. If you are between 13 and 15, you may only use the platform with the verifiable consent of a parent or legal guardian who agrees to these Terms on your behalf. The service is not available to children under 13, and we do not knowingly collect personal data from anyone under 13. We reserve the right to request proof of age or parental consent at any time, and to suspend or delete accounts that do not meet these requirements.

To use certain features of GlobalCoach AI, you must create an account. You may register using an email and password, or through Google or Apple Sign-In. When registering, you agree to:

Provide accurate, current, and complete information
Maintain the security of your password and account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorised use of your account
Not create multiple accounts to circumvent usage limits, free-tier allowances, or subscription restrictions
Not share, sell, or transfer your account to any other person

5. Acceptable Use

You agree to use GlobalCoach AI only for lawful purposes. You must not:

Upload copyrighted material without proper authorization
Use the platform to distribute malware or harmful content
Attempt to gain unauthorized access to our systems or other users' accounts
Use the service to harass, abuse, or harm others
Violate any applicable laws or regulations
Share your account credentials with others
Use automated systems, bots, or scrapers to access the service without permission
Use AI-generated test content to create commercial products, competing services, or for resale
Represent AI-generated content from the platform as your own original work in academic submissions, professional certifications, or other contexts where originality is required
Submit AI-generated essays, answers, or explanations from this platform as your own work in academic settings without disclosure

6. Document Upload and Content

GlobalCoach AI allows you to upload documents in various formats (PDF, DOCX, PPTX, TXT, and images). By uploading content, you:

Confirm that you have the right to upload and use the content
Grant us a limited, non-exclusive licence to process the content solely for the purpose of generating practice tests, study plans, and related educational features for your account
Understand that uploaded documents are stored securely on enterprise cloud infrastructure provided by Microsoft Azure Blob Storage, and used only for your learning purposes. We reserve the right to migrate to, or add, alternative cloud storage providers at any time, subject to equivalent or stronger security standards.
Accept that uploaded document text may be sent to third-party AI providers — including but not limited to Azure OpenAI (Microsoft), OpenAI, Google (Gemini), Anthropic (Claude), and any other AI model providers we may use now or in the future — for question generation, essay grading, and content extraction, and you consent to this processing
Accept that image uploads are processed through Microsoft Azure AI Vision (OCR) to extract readable text, and you consent to this processing
Accept that the maximum file size is limited to 250 MB per upload, and supported formats are PDF, DOCX, PPTX, TXT, JPG/JPEG, PNG, GIF, WEBP, TIFF, and BMP
Acknowledge that you are solely responsible for ensuring that uploaded content does not violate any third-party rights, including copyright, privacy, or confidentiality obligations, and does not contain sensitive personal data of others without lawful basis

7. AI Processing and Learning Data

By using GlobalCoach AI, you acknowledge and consent to the following:

Your uploaded document text, test answers, essay responses, and learning activity data are processed by AI systems — including but not limited to Azure OpenAI (Microsoft), OpenAI, Google (Gemini), Anthropic (Claude), and any other AI model providers we may integrate now or in the future — to generate questions, grade essays, produce performance summaries, and provide adaptive recommendations.
The platform tracks your per-concept mastery, test history, confidence levels, response patterns, and spaced repetition schedules to personalise your learning experience. This data is stored in our database and used to power adaptive learning features.
AI essay grading uses automated rubric scoring across four dimensions (content accuracy, depth of analysis, concepts covered, clarity). These scores are machine-generated approximations and may not reflect the assessment that a human expert would provide.
Performance summaries, adaptive insights, readiness scores, and study recommendations are generated by AI and are not reviewed by human educators before being displayed to you.
We do not use your uploaded documents or personal data to train AI models. Document content is sent to third-party AI providers solely for real-time generation and is not retained by those providers beyond the processing of your request, in accordance with their respective enterprise data processing terms. We reserve the right to change, add, or replace AI providers at any time without prior notice.

8. Subscription and Payments

GlobalCoach AI offers both free and premium subscription plans:

Free Plan: Limited access including 2 AI-generated practice tests per calendar month (across document-based, library, and certification tracks combined), basic test types (MCQ, True/False, Flashcard), access to non-premium learning library topics and certification tracks, and one active study plan.
Premium Plan: Full access to all features including unlimited practice test generation, essay tests with AI grading, exam mode, multi-document tests, adaptive learning with concept-level mastery tracking and spaced repetition, all certification and exam preparation tracks, unlimited study plans, and AI-generated performance summaries.
Organisation Plans: Organisation subscriptions may be billed based on seats, licence term, and negotiated commercial terms. Organisation administrators are responsible for seat allocation and subscription compliance.
Payments are processed securely through Stripe. We do not store your payment card details; Stripe is the controller for payment card data in accordance with its own privacy policy.
Subscriptions automatically renew at the end of each billing period (monthly or annual, as selected) unless cancelled before the renewal date. You may cancel at any time via your Profile page, which opens the Stripe Customer Portal. Cancellation takes effect at the end of the current paid period, and you retain Premium access until then.
Regional pricing applies. Prices vary by country and are displayed in your local currency where supported; indicated prices exclude applicable taxes (e.g. VAT/GST) unless stated otherwise.
Promotional discounts (including student discounts and limited-time offers) are subject to verification and may be revoked if obtained fraudulently or in breach of these Terms.
Refunds are handled on a case-by-case basis. Except where required by applicable law, we are not obligated to provide refunds for partial subscription periods, for unused features, or for dissatisfaction with AI-generated content quality.
Right to withdraw (UK/EEA consumers): If you are a consumer in the United Kingdom or European Economic Area, you would ordinarily have 14 days to withdraw from a digital service purchase. However, because Premium features become available to you immediately upon successful payment, by completing your purchase you expressly request that the service begins during the withdrawal period and acknowledge that you lose your statutory right to withdraw once the service has been fully supplied. This does not affect your other statutory consumer rights.

9. Organisation / Teams (B2B)

GlobalCoach AI supports organisation workspaces with seat-based licensing, user invitations, role-based access, group management, organisation documents, assigned assessments, and organisation-level reporting.

Organisation responsibility: The organisation is responsible for all activity by its users, admins, and invited members within its workspace.
Admin responsibility: Organisation admins are responsible for user access, permissions, invite controls, and compliance with applicable law and policy.
Seat licensing: Access may be limited by active seat counts and licence terms. We may suspend or restrict over-capacity usage.
Org billing: The organisation is financially responsible for organisation subscriptions, seat commitments, and related charges.
Access control: We may suspend organisation or member access for misuse, security concerns, non-payment, or legal/regulatory reasons.

10. Intellectual Property

The GlobalCoach AI platform, including its design, features, technology, adaptive learning algorithms, and software, is owned by us and protected by intellectual property laws. You retain ownership of your uploaded documents.

AI-generated practice tests, questions, explanations, essay feedback, study plans, and other content generated by the platform are provided for your personal educational use only.
You may not reproduce, distribute, sell, licence, or commercially exploit AI-generated content from the platform without our prior written consent.
Certification names, exam names, and provider logos referenced on the platform are trademarks of their respective owners and are used for identification purposes only.

11. Privacy, Data Collection and Communications

Your privacy is important to us. By using GlobalCoach AI, you consent to the collection and processing of:

Account information (name, email, country, authentication provider — email/password, Google, or Apple — and OAuth provider identifier where applicable)
Uploaded document content and extracted text (for AI question generation, study plan creation, and document section extraction)
Test responses, essay submissions, scores, and performance data
Confidence level selections and learning event telemetry (for adaptive mastery tracking)
Concept mastery profiles and spaced repetition schedules
Study plan activity, daily task completion data, and streak information
Billing metadata from Stripe (customer ID, subscription status, billing cycle, subscription end date). We do not store payment card details.
Email communication preferences, including opt-out status for non-transactional messages
Usage analytics and session data (via Google Analytics)

Email communications

We send two categories of emails using Resend as our email service provider:

Transactional emails — such as password reset emails, account security notifications, and billing receipts. These are necessary for the operation of your account and cannot be opted out of while your account is active.
Non-transactional emails — such as daily study plan reminders. You may opt out at any time by clicking the unsubscribe link included in every such email, or by managing your communication preferences from your Profile page. Opting out does not affect transactional emails.

Your privacy rights

Depending on your jurisdiction (including the UK GDPR and EU GDPR), you may have the right to: access the personal data we hold about you; request correction or deletion of your data; object to or restrict certain types of processing; request a portable copy of your data; and withdraw consent where processing is based on consent. You may also lodge a complaint with a supervisory authority — in the UK this is the Information Commissioner's Office (ICO) at ico.org.uk. Key service providers (sub-processors)

We rely on the following providers to operate the service. Each acts as a processor under a data processing agreement where required:

Neon — managed PostgreSQL database hosting
Microsoft Azure — Blob Storage for uploaded documents, Azure OpenAI for AI generation and essay grading, and Azure AI Vision for image OCR
OpenAI, Google, Anthropic — additional AI model providers we may use for generation and grading
Stripe — payment processing and subscription management
Resend — transactional and non-transactional email delivery
Google Analytics — anonymised usage and session analytics
Vercel — application hosting and content delivery

Cookies

We use strictly necessary cookies for authentication and session management (e.g. HttpOnly JWT session cookies), and analytics cookies via Google Analytics to understand how the platform is used. You can control non-essential cookies through your browser settings.

We process the data above to provide, secure, and improve our services, comply with legal obligations, and enforce these Terms. For more detail, see our Privacy Policy. We do not sell your personal data.

12. Limitation of Liability

To the maximum extent permitted by applicable law, GlobalCoach AI, its owners, operators, directors, employees, and affiliates shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform
Any loss of profits, data, business opportunities, or goodwill
Any errors, inaccuracies, hallucinations, or omissions in AI-generated content, including but not limited to questions, answers, explanations, essay grades, rubric scores, feedback, mastery scores, readiness assessments, and study recommendations
Any decisions made or actions taken based on content, scores, or recommendations provided by the platform
Failure to pass any exam, certification, academic assessment, or professional evaluation, regardless of the user's engagement with the platform
Any academic, educational, or professional consequences resulting from your reliance on AI-generated outputs
Inaccuracies in adaptive learning recommendations, mastery scores, spaced repetition schedules, or concept proficiency assessments
Any interruption, downtime, data loss, or unavailability of the service
Academic consequences, including but not limited to allegations of academic dishonesty, arising from misuse of AI-generated content
Any damages arising from the processing of your data by third-party AI providers or cloud infrastructure services

The platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

In jurisdictions that do not allow the exclusion of certain warranties or the limitation of liability for certain damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed the amount you have paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless GlobalCoach AI, its owners, operators, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) content you upload to the platform; or (e) any misrepresentation regarding your use of AI-generated content.

14. Your Responsibility to Verify

You accept full responsibility for verifying the accuracy and suitability of all content generated by the platform. Specifically:

Answers and Explanations: AI-generated correct answers and explanations may be wrong. Always cross-check against official textbooks, course materials, or authoritative sources.
Essay Grades and Feedback: AI rubric scores and written feedback are automated estimates. They may misjudge the quality, accuracy, or completeness of your responses. Do not treat them as equivalent to expert human assessment.
Mastery and Readiness Scores: Concept mastery percentages, readiness assessments, and adaptive recommendations are based on algorithmic analysis of your practice test performance. They are indicative only and should not be your sole measure of preparedness for any exam or assessment.
Certification and Exam Preparation: Practice content for professional certifications and standardised tests is AI-generated and may not accurately reflect the scope, format, or difficulty of actual exams. Always supplement with official preparation materials from the relevant certification body or examination board.
Study Plans: AI-generated study plans are suggestions based on limited information. You are responsible for adjusting them to your actual learning needs, schedule, and pace.

15. Termination and Account Deletion

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms, suspected fraud or abuse, non-payment, or for any other reason at our reasonable discretion. You may also request deletion of your account at any time by contacting us at support@globalcoachai.com. Upon termination or deletion:

Your right to use the service will immediately cease
Your uploaded documents stored in Azure Blob Storage will be deleted, along with your mastery data, learning history, test responses, essay submissions, and study plans
Anonymised or aggregated data that no longer identifies you may be retained for analytics and service improvement purposes
We may retain limited records (such as billing history and records needed for legal, tax, fraud prevention, or regulatory compliance) for as long as required by applicable law
Active subscriptions will not be automatically refunded unless required by applicable law, but will not renew after the current billing period

16. Governing Law and Disputes

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales. Where mandatory consumer protection laws of your jurisdiction apply, nothing in these terms limits your statutory rights.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Changes to Terms

We may update these Terms and Conditions from time to time. We will notify users of significant changes by posting a notice on our platform or sending an email to the address associated with your account. Your continued use of the service after changes constitutes acceptance of the updated terms. If you do not agree with the revised terms, you should stop using the platform and delete your account.
